Welcome to InstaQuote. These Terms of Service ("Terms") govern your use of the InstaQuote web application available at https://instaquote.company (the "Service").

By accessing or using InstaQuote, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Service Description

InstaQuote is a web application that helps contractors and home service professionals create professional estimates, generate PDF estimates, manage customer information, and save estimate records. The Service supports various trades including, but not limited to:

• Plumbing & Roofing
• Electrical & Painting
• Drywall & Carpentry
• HVAC & Landscaping
• Fencing & Cleaning
• Handyman services
• Other home service trades

2. Account Registration and Security

2.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to:

• Keep your password confidential and secure
• Immediately notify us of any unauthorized use of your account
• Log out from shared or public devices after use

2.3 Account Eligibility

You must be at least 18 years old to create an account. By using the Service, you represent and warrant that you meet this requirement.

3. User Responsibilities

3.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to create misleading, fraudulent, or deceptive estimates
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to transmit any material that is harmful, offensive, or unlawful
• Reverse engineer, decompile, or disassemble the Service
• Remove or alter any proprietary notices or labels in the Service
• Use automated means (bots, scrapers, crawlers) to access the Service

3.2 Accuracy of Estimates

InstaQuote provides tools to help you create estimates. It is your sole responsibility to ensure the accuracy of all pricing, quantities, and information included in your estimates. InstaQuote does not verify the accuracy of estimates and assumes no liability for errors, omissions, or miscalculations in estimates created through the Service.

4. Intellectual Property Rights

4.1 Our Intellectural Property

The Service, including its original content, features, functionality, software, trademarks, logos, and design elements (excluding user-generated content), is owned by InstaQuote and is protected by intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

4.2 Your Content

You retain all ownership rights to the estimates, customer data, and other content you create using the Service ("User Content"). By using the Service, you grant InstaQuote a limited, non-exclusive, worldwide license to host, store, and process your User Content solely for the purpose of providing and improving the Service. We will not sell, license, or otherwise exploit your User Content for commercial purposes outside of the Service.

5. Pricing and Payment

5.1 Free Tier

InstaQuote offers a free tier that allows you to create a limited number of estimates. The free tier may have limitations on the number of estimates or available features at any given time.

5.2 Subscriptions

Premium features are available through a subscription plan. By subscribing, you agree to:

• Pay all fees associated with your subscription at the rates then in effect
• Provide valid and current payment information
• Authorize us to charge your payment method for recurring payments

5.3 Refunds

Subscription fees are non-refundable unless required by applicable law. If you believe you are entitled to a refund, please contact us.

6. Service Availability

InstaQuote strives to provide a reliable and secure Service. However, we do not warrant that the Service will be available at all times, uninterrupted, or error-free. We may perform scheduled maintenance or experience unscheduled downtime. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

7. Third-Party Services

The Service may integrate with or link to third-party services, including Firebase, Google Analytics, and Meta Pixel. Third-party services are governed by their own terms of service and privacy policies. InstaQuote is not responsible for the content, terms, or practices of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. INSTAQUOTE DOES NOT WARRANT THAT:

• The Service will meet your specific requirements
• The Service will be available, secure, or error-free
• Estimates generated through the Service will be accurate, complete, or suitable for your intended purpose
• The results that may be obtained from the use of the Service will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSTAQUOTE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any estimates, quotes, or pricing created through the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission related to the Service
• Any bugs, viruses, or similar issues transmitted through the Service
• Errors or omissions in any estimates, regardless of cause

IN NO EVENT SHALL INSTAQUOTE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO INSTAQUOTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

10.1 By You

You may terminate your account at any time by contacting us. Upon termination, you will lose access to all features and data associated with your account unless you export your data before deletion.

10.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without cause, without prior notice. This includes, but is not limited to, violation of these Terms, fraudulent activity, or prolonged inactivity.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the federal or state courts.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Service or by sending an email to your account. Continued use of the Service after changes constitutes acceptance of the modified Terms.
